Fall Fix Up Participatory Agreement

PARTICIPATORY AGREEMENT
THIS PARTICIPATORY AGREEMENT (the “Agreement”) is executed on this 7th day of November 2021; by the "Volunteer" (listed below) in favor of JEWISH FAMILY SERVICE (“JFS”), a Michigan nonprofit corporation (collectively “JFS”) its affiliated organizations, directors, officers, employees, agents and representatives.
The Volunteer desires to participate in the activities associated with the Project. The Volunteer understands that the activities may include being transported to and from work site locations and consuming food donated to the Project.
The Volunteer agrees to the following:
- WAIVER AND RELEASE
Volunteer does hereby release, defend, indemnify and hold JFS harmless, its affiliated organizations, successors, and assigns from any and all liability, claims and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Volunteer’s participation in the Project.
Volunteer understands that he/she is releasing JFS from any and all liability or claim that the Volunteer may have, has had or could have against JFS with respect to any bodily injury, illness, death or property damage that may result from Volunteer’s participation in the Project, regardless of the cause. Volunteer also understands that JFS does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance.
- MEDICAL TREATMENT
Volunteer does hereby release and forever discharge JFS from any claim whatsoever which arises or may hereafter arise on account of any first aid treatment, or service rendered in connection with the Volunteer’s participation in the Project. If medical attention is needed the day of the event, please contact 911 immediately.
- ASSUMPTION OF THE RISK
The Volunteer understands that the Project may include activities that may be hazardous to the Volunteer and that food and accommodations may be donated to JFS. Volunteer hereby acknowledges and assumes the risk of injury or harm with respect to these activities and releases JFS from any and all liability for injury, illness, death or property damage resulting from the activities of the Volunteer’s participation in the Project.
- COVID-19 Acknowledgement
While participating in events held or sponsored by JFS, “social distancing” must be practiced and face coverings worn at all times to reduce the risk of exposure to COVID-19. Because COVID-19 is spread mainly from person-to-person contact, JFS has put in place preventative measures to reduce the spread of COVID-19; however, JFS cannot guarantee that the Volunteer will not become infected with COVID-19.
In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below on the day of the event (November 7, 2021) should not engage in the Project. By participating in the Project, the Volunteer certifies that they do not fall into any of the following categories:
- Individuals who currently within the past fourteen days (since Sunday, October 24) have experienced any symptoms associated with COVID-19, which include fever, cough and shortness of breath, among others;
OR
- Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.
The Volunteer does hereby acknowledge the contagious nature of COVID-19 and voluntarily assumes the risk that he/she may be exposed to or infected by COVID-19. The Volunteer understands and agrees to the following:
- Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist;
- The Volunteer knowingly and freely assumes all such risks related to exposure and infection of COVID-19 and accepts sole responsibility to any injury to themselves or to their child(ren), even if arising from the negligence or fault of JFS.
- Duty to Self-Monitor
The Volunteer agrees to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough and shortness of breath) and contact JFS at fallfixup@jfsdetroit.org if he/she experiences any symptoms of COVID-19 within 14 days after volunteering with JFS.
- INSURANCE
Each Volunteer is expected and encouraged to arrive with his/her own medical or health insurance coverage in effect.
- PHOTOGRAPHIC RELEASE
Volunteer does hereby grant and convey to JFS all of its right, title and interest in any and all photographic images, video and/or audio recordings made by JFS during the Project, including but not limited to, any royalties, proceeds or other benefits that may be derived form such photographs or recordings.
- MISCELLANEOUS
Volunteer expressly agrees that the release being given is intended to be as broad and inclusive as permitted by Michigan law. Volunteer agrees that in the event that any clause or provision of this Release is held to be invalid by a court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this release, which shall continue to be enforceable.
